On 14th September 1963, ICAO’S Tokyo Convention (TC63) governing offences and certain other acts committed on board aircraft, was the first jurisdiction to address unruly passengers.
However, there were gaps in the Convention (TC63) allowing many unruly passengers escape punishment. The main issue was that the State where an aircraft is registered only had jurisdiction over offences committed onboard. To address this, States agreed that amendments were needed, and this resulted in the Montreal Protocol 2014 (MP14). MP14 amended TC63 by extending jurisdiction over offences to the State of intended landing (destination) in addition to the State of aircraft registration.
